Land Information New Zealand and eDealing
Land Information New Zealand is a database for land title and survey information, which is used by surveyors, lawyers and other land professionals and it is changing.
For some time now, Land Information New Zealand have been phasing out “paper” documents in order for all registration to be done electronically, which is more cost and time effective. This is expected to be completed in 2009.
Some of you may remember going to your solicitor’s office and having to sign a “mortgage” or “transfer” document. These documents have now been replaced with Client Authority and Instruction forms.
Client Authority and Instruction forms enable you to authorise your solicitor to sign a “digital document” on your behalf in the Land Online website. The Client Authority and Instruction form itself is two pages long and sets out the property details to which the underlying documents relate, the mortgagee and transferor/transferee details. You will be required to sign the Client Authority and Instruction form in front of an adult witness (usually the solicitor) and provide a copy of your driver’s licence. This will enable your solicitor to “sign” the digital document electronically on your behalf.

Not only is the cost for registration of documents electronically with Land Information New Zealand less expensive, it is immediate. Perhaps you have purchased a property and on settlement day, provided one is able to register electronically before 4 pm, you will immediately be registered on the certificate of title as the new legal owner of your home. Any mortgage involved will obviously also be registered at the same time, meaning that both the registered proprietor and the mortgagee have the peace of mind that registration has been completed.
