Real estate companies

It’s was common for companies to sell subdivisions in cities. Some companies that started in the 19th century are still around today, such as Harcourts who were founded in 1888 and have gradually expanded their business over the years.

Land Agents Act 1912

The Land Agent’s Act 1912 was the first to regulate the work of agents. They had to have a licence to do business, and violating such or misusing trust funds would incur penalties.

Real Estate Institute of New Zealand

Some land agents felt that the 1912 act did not offer enough protection to licensed agents, and didn’t stop undesirable people from becoming one. Concerns led to the creation of a nationwide organisation for land agents. Several regional organisations, including those in Wellington, Auckland, and Waikato have formed the Dominion Estate Agents and Land Auctioneers Association Other regional associations joined, and in 1923 the association was renamed the Real Estate Institute of New Zealand (REINZ).

Law changes

One of REINZ’s main goals was to better regulate the agents’ business. The changes in the Land Agents Act 1921-1922 strengthened agents’ accountability, and then the 1953 act allowed REINZ to manage their business on a professional level.

Real Estate Agents Act 1963 is the first major change in NZ real estate. It forces agents to join REINZ, which has the power to set industry standards, test members and enforce discipline. A licensing board was created under the Real Estate Agents Act 1976 and this would be able to regulate the real estate industry. However, REINZ still had its role in terms of regulating the business.

A new act, the Real Estate Act 2008, came into force in late 2009. As a result, REINZ no longer has regulatory powers but it carries on being important for both property professionals and consumers.
